Terms and conditions of accommodation services

BOOKING ACCOMMODATION

Booking of the villa is done exclusively by email. After accepting the booking offer, the guest is obliged to accept in full the terms and conditions of reservation which he has previously studied.

When booking the selected accommodation, the guest pays 30% of the non refundable advance amount within 5 working days, and the difference to the full price he pays 30 days prior to arrival, unless otherwise agreed in the offer.

The guest can pay only by bank transfer.

If booking is made within 30 days prior to arrival – no prepayment payment will be offered, but you will need to pay the total amount by bank transfer.

Once the advance payment is received, Villas Borghetto sends the guest the booking confirmation (voucher).

The rest of the accommodation price can be paid 30 days before arrival by bank transfer or upon arrival.

SERVICE PRICE AND CURRENCY

The accommodation price is stated on the website and in the offer.

Special services provided by the accommodation unit are not included in price and guests will, therefore, be charged extra for them, as a separate service.

According to the current Law on the Residence Tax of the Republic of Croatia, the guest is obliged to pay the residence tax. The final amount of the residence tax for a particular reservation depends on the destination in the Republic of Croatia where the accommodation unit is, the term of stay, the number and age group of the traveler.

All types of extra services that are not included in the accommodation price the guest is obliged to order upon reservation or by appointment, and make the payment by bank transfer or on the spot.

The published prices on the websites expressed in EUR are based on the domestic currency of KUNA according to the fixed conversion rate.

 

TRAVEL DOCUMENTATION

Travel documentation, booking confirmation of total payment with details about check-in / check-out, is sent to guests by e-mail and serves as an accommodation voucher.

 

ACCOMMODATION

Check-in in Villas Borghetto is possible from 16.00 to 20.00 o’clock on the day of arrival. Arrival after 20.00 o’clock is necessary to announce in advance. The guest needs to leave the accommodation by 10.00 o’clock on the day of service is to be finished.

Pets are allowed only on request and prior notice, and are subject to a mandatory supplement.

Only the number of registered guests, including the children, specified in the booking confirmation may use accommodation service. Additional persons, including children not announced and exceeding the number of beds, can not use the accommodation service in Villas Borghetto. 

Supplements:

  • Extra beds are possible on request for children under 14 years at extra cost (maximum 2 extra beds)
  • Baby cot on request at extra cost
  • Pets on request at extra cost
  • Final cleaning is a mandatory surcharge in all the villas (the price depends on the villa)
  • Deposit is obligatory for all villas upon arrival and is refunded if no damage is done to the facility
  • Residence tax is obligatory and is charged according to the local rate upon arrival.

Youth groups are considered guests younger than 25 years. The guests are obligated to inform Villas Borghetto about the age of the persons in a group when booking the accommodation. If the guests don’t do it, Villas Borghetto can cancel the booking with no refund of the paid advance payment.  If such a group comes on a check in, Villas Borghetto can refuse to accommodate the group with no refund of the paid advance payment.

 

CANCELLATIONS

If the guest cancels the reservation, Villas Borghetto reserves the following amount of the total reservation price:

  • cancellation of more than 46 days prior to arrival – 30% of the total price of the reservation
  • for cancellations from 45 to 36 days before the day of arrival –  50% of the total reservation price
  • cancellation from 35th to 16th day before arrival – 80% of the total reservation price
  • for cancellation from the 15th day to the no-show on the day of arrival – it holds 90% of the total reservation price
  • for NO SHOW reservations or cancellation on the arrival day, 100% of the total price is charged.

 

If the guest cannot travel in the period he has booked, he can once change the dates of traveling to another free period or change the name of the travelers.

If the guest does not arrive in the booked accommodation until midnight on the day of use of the service, without informing Villas Borghetto about late arrival (late arrival implies arrival after 20.00 o’clock), the reservation is considered to be canceled and the cost of cancellation of the reservation is calculated according to the above conditions.

All the guests are required to have valid personal travel documents. They are used only for registration of the clients and only for this purpose. Irregular documents, which result in the cancellation of the reservation, and if due to such a failure Villas Borghetto incurred additional damage, the guest is obliged to compensate for it.

Travel insurance, damage insurance and cancellation insurance are not subject to these general terms, and the guest is advised to individually conclude such insurance.

If Villas Borghetto needs to cancel to the guest the already booked facility for some unusual or unforeseen circumstances, Villas Borghetto are obliged to offer to the guest a replacement of the same or higher quality accommodation or to make a refund of the amount paid for the reservation.

 

LIMITATION AND EXCLUSION OF LIABILITY

Villas Borghetto is not responsible for any injury, loss, death, inconvenience, delay, damage to personal property or other damage related to the provision of any goods or services, whether as a result of, but not limited to, the effects of force majeure, disease, pandemic and epidemic, war crimes, civil unrest, riots, damage caused by animals, strikes or other work activities, any criminal or terrorist activities, overbooking or poor service, food poisoning, mechanical or other failures or aircraft or other means of transport of failure of any other transport mechanism to ensure the timely arrival or departure and any events beyond the control and or impact of Villas Borghetto.

 

Villas Borghetto shall not be liable for any damage and/or delay in providing the Accommodation service caused by force majeure. A force majeure event includes, but is not limited to, government action, war, political unrest and riots, civil strike, industrial disagreements, labor disputes, natural disasters, fire, theft, disease epidemics and pandemics, other diseases, weather conditions, quarantine, medical regulations, airport closures, vehicle failures, and other changes beyond our control. Villas Borghetto is not obliged to provide you with a refund (advance and/or balance, the full amount of Accommodation) if you cannot use the Accommodation due to force majeure that does not prevent the provision of the Accommodation service.

 

Neither Villas Borghetto is responsible for any terms or requirements of any third party that provides you with a particular service during your vacation other than the Accommodation service. If you decide that you do not wish to visit any country or part of the country you intended to visit due to any law, condition or requirement of any government, official or agent, you are solely responsible for all costs and fees, loss or damage incurred as a result as well as any cancellation fees or amended fees.

 

COMPLAINTS

The guest must lodge a complaint regarding damage, insufficient cleaning or defects no later than 24 hours from the commencement of the rental period. If a guest lodges a written complaint after that deadline, Villas Borghetto is not required to take any notice and it will be considered that the guest has taken over the booked accommodation unit in a proper and orderly condition and will lose the right to complain.

It is in the interest of the guest to try to solve his complaint immediately at the destination. If there is no improvement after the objection, the guest must request confirmation that the service is not provided or not provided in the manner agreed upon. The guest must enclose this certificate with the written complaint.

Villas Borghetto is obliged to make a written decision on this complaint within 14 days of receipt of the complaint and may postpone the lodging of a complaint resolution for an additional 14 days for the collection of information.

Villas Borghetto will only address those complaints that could not be removed on the spot during the time of booking.

While the proceedings are up to date and a total of 14 or 28 days after the submission of the complaint, the Guest irrevocably waives the mediation of any other person, arbitration or other institution as well as providing information to the media.

The highest amount of compensation for the complaint can reach the amount of the advertised piece of service and it can not include the services already used, as well as the total amount.

The guest and Villas Borghetto shall endeavor to settle disputes by mutual agreement, unless they are subject to the decision of the competent court in Poreč, where the relevant Croatian law is applicable.

 

OBLIGATIONS OF VILLAS BORGHETTO

Villas Borghetto are obliged to take care of the services performed as well as the choice of the service provider, paying attention to the good businessman and to take care of the rights and interests of the guest in accordance with good practices in tourism. Villas Borghetto are obligated to provide all agreed services to the guest and to provide answers to any non-performance of the service or part of the service.

 

GUIDELINES FOR GUESTS

The guest is obliged to make sure that he personally fulfills the conditions stipulated by the regulations of the Republic of Croatia and the country through which he travels and to comply with the house rules in the facilities of Villas Borghetto.

The guest is responsible for the damage caused, and the related costs are borne on the spot at Villas Borghetto.

 

LUGGAGE

The guest is obliged to take care of the things that are included in the accommodation. The guest is responsible for theft, loss or damage of things left without his supervision. Villas Borghetto does not respond to any damaged, destroyed or lost luggage, as well as for theft of luggage or valuables in the accommodation facility (it is advisable to rent a safe if there is such a possibility or payment of the insurance package where luggage is provided). Lost luggage or theft the guest is required to report to the accommodation provider and the competent police station.

 

DAMAGE / SECURITY DEPOSIT

Security amount will be confirmed to you during the process of booking a villa. If there is no need to keep the security deposit, it will be returned to you after the end of your stay in the villa. While retaining the full amount of the security deposit, Villas Borghetto serves the right to contact you within 48 hours after inspection of the villa to inform you if it is found that you must compensate the difference to the actual amount of damage.

If you discover any problems or damages on arrival, you are obliged to report them immediately to the partner or agency to avoid any misunderstandings after the end of the stay.

 

PERSONAL DATA PROTECTION

Guest personal information is provided voluntarily. The personal information of the guest is required in the booking process and is used exclusively for further communication and the obligation to register the guest in the E-visitor system. Villas Borghetto undertakes not to disclose Personal Information from the Country or to third parties, except for the purpose of realizing the requested service.

The personal data of the guest will be kept in the database, according to the Management’s decision on how to collect, process and store personal data.

 

PUBLISHING

If a guest sends a review of the accommodation, we reserve the right to publish it on our website. If the guest specifically requests to move reviews, Villas Borghetto will do so in the shortest possible time.
